⚠ Common Disallowed-Cost Pitfalls

  • Financial & Cost Eligibility: Costs for ineligible activities or activities exceeding plan scope are disallowed and not reimbursable from captured TIF revenue
  • Environmental: Environmental activities performed without EGLE approval cannot access state education or school operating tax capture; costs are disallowed
  • Financial & Cost Eligibility: Costs that receive both EGLE grant and TIF reimbursement are disallowed; developer must repay duplicative amount
  • Reporting: Non-compliance status may affect future awards or trigger review of prior-year reimbursements
  • Ongoing Eligibility: Failure to pass or provide background check results in denial of award or clawback if fraud discovered post-award

Reporting

    BRAs must submit annual project activity reports to MEDC. BRAs are not considered compliant until MEDC Brownfield Staff have reviewed and approved all reported data.

    Deadline: By August 31 each year via online portal

Financial & Cost Eligibility

    Developer costs must be limited to eligible brownfield activities as identified in the approved Brownfield Plan. Only activities sufficient and necessary to complete the eligible work qualify for reimbursement.

    Deadline: Must be established in approved Brownfield Plan before project begins

  • Clawback riskOne Time

    If EGLE grant funds are used for any activity, that activity must be clearly identified and separated from TIF-funded activities to prevent double-reimbursement for the same cost.

    Deadline: Must be segregated in approved brownfield plan and tracked during project execution

Environmental

  • Clawback riskEvent Driven

    Environmental activities including soil and groundwater contamination remediation must be reviewed and approved by EGLE before they may use state tax capture funds.

    Deadline: Approval must be obtained before activity commences or before state tax capture is used

Ongoing Eligibility

    All MSF incentive requests of $15,001 or more require background checks on applicants/developers. MSF Background Review Policy governs procedures.

    Deadline: Background check completed as part of due diligence before award
